Plain-English Summary

  • By using our shop you agree to these terms. You must be old enough to form a binding contract and, where required, to buy the products we sell.
  • Accounts must be accurate and secure; you are responsible for activity under your account.
  • Orders are offers we can accept or decline; pricing and availability can change until we confirm. Taxes and shipping costs are as shown at checkout.
  • We currently ship within Israel via our chosen carriers; delivery times are estimates. Risk passes to you when we hand the order to the carrier (unless we say otherwise).
  • Returns and refunds are offered as described (e.g. within 14 days for eligible items). Exchanges and cancellations follow our stated policy.
  • What you order is what you get: We ship the exact product(s) you order. What you see on the website and add to your cart is what we deliver. If we ever need to substitute an item (e.g. stock unavailability), we will notify you.
  • Our content and branding are protected; you may not misuse the site or submit content that infringes others' rights. We may use or moderate reviews and user content as set out below.
  • Promotions have their own rules; we reserve the right to modify or end them. We disclaim warranties to the extent permitted by law and limit our liability as set out in these terms.
  • These terms are governed by the laws of the State of Israel. Disputes may be resolved in the courts of the State of Israel; [optional arbitration add-on]. We may change these terms and will notify you of material changes.

1. Eligibility and Acceptance

By placing an order or using MyMarketHQ, you confirm that you are at least the age of majority in your place of residence (or have parental/guardian consent) and are able to form a binding contract. We may refuse service or cancel orders where we reasonably believe these terms have been violated or for other legitimate business reasons. These terms apply in addition to our Privacy Policy and any other policies we publish on the site.

2. Accounts

If you create an account, you must provide accurate and current information and keep it updated. You are responsible for keeping your password secure and for all activity under your account. Notify us promptly at carsm0delbyjoseph@gmail.com if you suspect unauthorised use. We may suspend or close accounts that breach these terms or for operational or legal reasons.

3. Orders, Pricing, and Taxes

  • Orders: Placing an order is an offer to buy. We accept when we confirm the order (e.g. by email). We may decline or cancel orders (e.g. errors, suspected fraud, or stock issues) and will refund any payment already taken if we do not fulfil the order.
  • Pricing: Prices are as shown at checkout at the time you place your order, in the currency selected. We reserve the right to correct pricing errors and to change prices for future orders. Promotional prices apply only as stated (e.g. time-limited, for specific products).
  • Taxes: Applicable taxes (e.g. VAT, sales tax) are calculated and shown at checkout where we are required to collect them. You are responsible for any additional taxes or duties in your country unless we state otherwise.

4. Shipping and Delivery

  • Shipping: We currently ship within Israel using our chosen carriers (e.g. via Shopify Shipping and partner carriers). Shipping options and costs are shown at checkout. We will use the delivery address you provide; we are not responsible for errors in addresses you supply.
  • Delivery times: Stated delivery windows (e.g. "3–5 business days") are estimates only. We are not liable for delays caused by carriers, customs, or events outside our control. If a delivery is significantly delayed, contact us and we will try to help within the scope of our policy.
  • Risk and title: Risk of loss and title pass to you when we hand the goods to the carrier (or as otherwise stated in your order confirmation). We recommend insuring high-value orders if you wish.

5. Returns, Refunds, and Exchanges

  • Return window: You may return eligible items within 14 days of delivery in unused, resaleable condition with original packaging where reasonable. See our Shipping & Returns page for full details.
  • Refunds: Refunds will be issued to the original payment method once we receive and approve the return. Processing may take 5–10 business days after we receive the item.
  • Exchanges: Exchanges are subject to availability and our exchange policy as published on the site. We may offer an exchange or store credit instead of a refund where appropriate.
  • Non-returnable items: Certain items (e.g. personalised goods, perishables, or items marked non-returnable) may be excluded; this will be stated on the product or returns page.
  • Costs: Unless we have made an error or the item is faulty, return shipping may be at your cost unless we state otherwise.

6. Cancellations

You may cancel an order before it has been shipped by contacting us at carsm0delbyjoseph@gmail.com. Once the order has shipped, our returns policy applies instead. We may cancel orders (e.g. stock issues, fraud, or breach of terms) and will refund any payment if we do not fulfil the order.

7. What You Order Is What You Get

We sell specific products shown on our website. When you place an order, you receive the exact product(s) you selected—what you see and add to your cart is what we ship. We do not sell "surprise" or "mystery" boxes; each product is clearly identified before purchase. If we are unable to fulfil an item (e.g. out of stock after you order), we will notify you and offer a refund or replacement as appropriate under our returns policy.

8. Intellectual Property

All content on our site (e.g. text, images, logos, design, product photography) is owned by us or our licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or use our content for commercial purposes without our prior written permission. You may link to our site in a fair and non-misleading way.

9. Acceptable Use and User Content

  • Acceptable use: You may not use the site or your account for illegal purposes, to harm others, to transmit malware, to scrape or overload our systems, or to impersonate anyone. We may suspend or terminate access and report activity to authorities where appropriate.
  • Reviews and user content: If you submit reviews, comments, or other content, you grant us a non-exclusive, royalty-free licence to use, display, and modify that content in connection with our business (e.g. on the site, in marketing). You must not submit content that is false, defamatory, infringing, or otherwise unlawful. We may remove or refuse to publish content at our discretion and are not obliged to monitor all user content.

10. Promotions

Promotions (e.g. discounts, giveaways) may have additional rules (e.g. eligibility, dates, limits). Those rules form part of these terms for that promotion. We reserve the right to modify, suspend, or end promotions early and to correct errors, subject to applicable law.

11. Disclaimers

To the fullest extent permitted by law, the site and products are provided "as is." We disclaim all warranties not expressly stated (e.g. we do not warrant that the site will be uninterrupted or error-free). Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law (e.g. consumer rights in your jurisdiction).

12. Limitation of Liability

To the fullest extent permitted by law, we (and our directors, employees, and agents) are not liable for any indirect, incidental, special, consequential, or punitive damages (e.g. loss of profit, data, or goodwill) arising from your use of the site or products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from or related to these terms or your use of the site or products shall not exceed the amount you paid us for the relevant order in the [e.g. twelve (12)] months before the claim, or [ALTERNATIVE CAP, e.g. one hundred (100) units of currency], whichever is greater. These limits apply except where prohibited by law (e.g. death or personal injury caused by our negligence, or mandatory consumer rights).

13. Indemnity

You agree to indemnify and hold harmless MyMarketHQ and its directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your breach of these terms, your use of the site or products, your violation of any law or third-party rights, or your user content.

14. Governing Law and Jurisdiction

We operate from Israel and currently sell within Israel. These terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Any dispute that is not resolved informally shall be subject to the exclusive jurisdiction of the courts of the State of Israel, and you consent to the personal jurisdiction of those courts.

15. Dispute Resolution — Arbitration (Add-on)

Enable this section if you want optional binding arbitration.

Except for small-claims court eligibility or injunctive relief, any dispute arising from these terms or the site may be resolved by binding arbitration administered by [ARBITRATION BODY] under its then-current rules. The arbitration shall be conducted in [LOCATION]. The arbitrator's award may be enforced in any court of competent jurisdiction. You and we waive any right to a jury trial or to participate in a class or representative action to the extent permitted by law. If any part of this arbitration clause is found unenforceable, the rest of the terms remain in effect.

16. Changes to These Terms
